Our program has been working hard to locate lead-free pottery, made in Mexico, to replace the very common lead-glazed ceramics that are sold in Latino-owned stores and our local flea markets. Lead-safe or food safe means that the pottery meets FDA limits for lead but is not free of lead. The company La Fortuna  produces pottery under the name Mi Pueblo that is labeled lead free. We hoped to promote their product but asked for lab results to be sure we were promoting a product that was truly safe. When the test results were not forthcoming, we took our XRF to a local tienda and tested pottery on the shelf. All of the Mexican pottery contained lead, even the pot from La Fortuna labeled lead free (see photos.) A laboratory test of the lead-free pot indicated that 0.95 ppm lead was leaching from the glaze, just below the FDA limit of 1.0 ppm. While it met the FDA limit for serving dishes, it obviously was not free of lead. Products sold in the US can contain lead as long as the lead does not leach from the glaze at levels that exceed the FDA standard. 

Lead can leach from glazes and enter food. Lead is a metal not naturally found in the human body and is harmful, especially to young children. Pregnant women pass lead to their fetus through the placenta.

We have identified several issues related to Mexican pottery

  1. There is much lead-glazed pottery for sale that is leaching lead and that has no warning label.
  2. Warning labels, if they exist, are mostly in English only.
  3. Warnings are required to be permanent but are often half-stamped on with ink or are imprinted but easily worn away.
  4. Pots labeled lead free are not truly free of lead. This is misleading.

 

It isn’t just pottery from Mexico that contains lead glaze. This Moroccan tagine (a covered baking dish), tested by the Department of Health in Austin TX, contained lead.

 

 

Guide to the Consumer Product Safety Improvement Act (CPSIA) for Small Businesses, Resellers, Crafters and Charities

Enacted in February 2009, the new law, the Consumer Product Safety Improvement Act, regulates lead content of all children’s products including toys, books, child-care articles, and clothing. Children, for the purposes of this law, are defined as ≤12 years old. This guide answers frequently-asked questions that small manufacturers, shop owners, and consignment/thrift-shop owners may have.

BE A SMART CONSUMER!

Beware of old toys sold at flea markets and yard sales. Here is an example of a toy found recently during a home inspection. It not only has lead-based paint, but also contains a lead weight that is accessible to young fingers and mouths. We contacted CPSC and were told that they now consider these “collectors items” and, therefore, don’t regulate them as children’s toys.
   

Keys can contain lead. Please keep keys away from children. Some are made of brass (gold in color) which contains lead and some may be brass but with a silver-colored coating. Never put keys in your mouth or allow a child to do so. Anyone handling keys should wash hands after handling, especially before eating.
   
Brass bells, candlesticks, and figurines contain lead. Keep these away from children.

  • In May 2009, Abalone and Venetian Carnevale Necklace Craft Kits, made in China, were recalled. The lobster clasps in both craft kits contain high levels of lead. The Abalone Necklace’s pendant also contains high levels of lead. The recall includes the children’s jewelry craft kits “Abalone Necklace” (item #67117) and “Venetian Carnevale Necklace” (item #67118). Both kits contain components to assemble necklaces including charms, beads, wire and clasps. The kit’s name, model number, and “Curiosity Kits” are printed on the product’s packaging.   • In April 2009, Playground Equipment, made in Turkey, was recalled. The handrails and posts on the playground contain high levels of lead paint. The recall involves the Tot Town Fun Center, Tot Town Castle Fun Center, Tea Cup Merry Go Round, 8 Web Climber, Rope Wall, Four Panel Circular Aztec Climber and Three Panel Aztec Climber.

They were sold by Authorized SportsPlay dealers nationwide from January 2003-December 2007 for between $1,300 and $5,500. Consumers should stop using the playground immediately if the painted parts have chipped off.   • In April 2009, Dinosaur Play Sets, made in China, were recalled. The surface paint on the monkey figure contains excessive levels of lead, violating the federal lead paint standard. This recall involves the Dinosaur Era 2 Hunting Dinosaur play set. Each play set contains a dinosaur, a helicopter, trees, a hunter, a monkey and various hunting equipment.   • In March, 2009, DBX Glide Boys Ice Skates, made in China, were recalled. Surface paint on the ice skates contains excessive levels of lead. The recalled youth adjustable boys ice skates are black with lime green and silver accents. “Glide” is printed on a rubber tag on the side of the skates. “DBX” and the DBX logo are located on the ice skate’s ankle powerstrap, tongue, and heel.   • In March 2009, Shakespeare Casting Game and Fishing Kits, made in China, were recalled. The label on the fishing rod contains a surface coating containing high levels of lead. The recalled Shakespeare Casting Game and Fishing Kit consists of a red and blue rod and reel with red foam targets and hook. The label is found on the front of the reel and reads “Casting Fun”.   • In March 2009, Nordstrom Girl’s Shoes, made in China, were recalled. Surface paint on the outer sole of these shoes contains excessive levels of lead. The recall includes six styles of Nordstrom-brand shoes for girls. “Clarice-Fab” flats are bone colored with a bow. “Eva-Fab” are bone colored T-strap sandals. “Fern-Fab” are ankle strap sandals sold in bone, pink, white, blue polka-dot or pink polka-dot. “Lilly-Fab” are fuchsia gingham ballerina flats with a bow. “Rita-Fab” are ankle strap dress shoes sold in ivory linen, pink linen, white linen, cafe satin, silver satin or white satin. “Vivi-Fab” are open-toe dress shoes in bone, white, green polka-dot, lavender polka-dot or yellow polka-dot. The shoes were sold in girls’ sizes 10 through big-kids 7. All shoes have an embossed “NORDSTROM” printed on the insole. Only the colors identified above are subject to the recall.

  • In March 2009, Solar System Kits and DNA Kits, made in the USA and China, were recalled. The surface coating on the educational kit’s wires can contain excessive levels of lead. This recall involves the “Solar System” and the “DNA” children’s educational craft kits sold under the FloraCraft and HYGLOSS brand names. The kits contain green coated wires that measure 14 ½ inches long and Styrofoam shapes. The following model numbers are included in this recall. The model number is located on the kit’s packaging.

  • In March 2009, Children’s Fishing Poles, made in China, were recalled. The paint on the reels of these fishing poles contains excessive levels of lead. This recall involves Zebco Advanced Youth Fishing Rod & Reel combo sets. The reels are painted orange and have the words “Zebco” and “ZAVS 10” on the reel handle. Only spinning reels are involved in this recall. They were sold at discount department and sporting good stores nationwide from August 2007-December 2008 for about $35.   • In March 2009, Children’s flip flops, made in Brazil, were recalled. Decorative paint on the sole of the flip flops can contain levels of lead in excess of the federal standard. Flip flops of the Havaianas brand containing decorative paint were sold under the following model names: Baby Estampas, Baby Pets, Kids Apple, Kids Fairy, Kids Flores, Kids Lighthouse, Kids Monsters, Kids Surf, Baby Letrinhas, Kids Sports, Kids Candies, Kids Fun, Kids Love, Kids Sereias, Kids Speed, Kids Lucky Bug, Kids Pets, Kids Rock, Kids Slim, Kids Wonder Woman, Kids Small Flowers and Kids Tropical w/Kit.   • In February 2009, Golfer's Billiard Games, made in China, were recalled. Surface paints on the golf balls can contain excess levels of lead. The recalled golfer’s billiard game includes 15 golf balls (with exterior paint and design to resemble a billiard ball) and six putting cups. The recall involves the Acuity Golfer’s Billiard Game, Style #AC302, and the Clubhouse Golfer’s Billiard Game, Style #302. The name and style number are located on the product’s packaging. The Acuity model was sold at Dick’s Sporting Goods stores nationwide from October-December 2008 for about $30. The Clubhouse model was sold at Golf Galaxy stores nationwide and on its Web site from May-December 2008 for about $30.   • In January 2009, “High Speed” Pull Back Toy Cars, made in China, were recalled. Surface paint on the toy cars contains excessive levels of lead. The recalled pull back toy car is yellow with “PROWL” printed on the side, “VICTOR” printed on the hood, and a blue and red police warning light on the top.   • In January 2009, Children’s Sunglasses, made in China, were recalled. Surface paint on the recalled sunglasses can contain excessive levels of lead. The two tone sunglasses come in Spiderweb Blue and Spiderweb Red with a spider web etched in between the eyes and “Made in China” engraved on the right-hand side of the frame.   • In January 2009, High School Musical Manicure Kits, made in China, were recalled. The lettering “HIGH SCHOOL MUSICAL” with glitter on the pouch used with the manicure kit contains excess levels of lead. This recall involves the pouch that contains the “High School Musical” manicure kit. The 7-1/2 inch by 4-3/4 inch plastic see-through pouch has a pink zipper with “High School Musical” printed in yellow gold with glitter and “Sharpay” printed in dark red on one side.   • In January 2009, Skull-And-Crossbones Necklaces, Made in China, were recalled. The skull and metal clasp of the necklace contain high levels of lead.   • In January 2009, Construction Play Sets, made in China, were realled. Surface paint on the play sets can contain lead, violating the federal lead paint standard. The play sets are packaged in a black and yellow box with the word “Builder” printed in the upper left hand corner of the package.   • In December 2008, Groovy Fashions™ Sassy Jammies™ Doll Clothing Sets, made in Indonesia, were recalled. Surface paints on the pajama pants contain excessive levels of lead. The recalled doll clothing set features a two-piece pajama set, eye mask and slippers. The pajama top is pink satin and the pants are dark brown with multiple-colored flowers printed on them.   • In December 2008, Army Figures, made in China, were recalled. Surface paint on the face of the Army figures contains excessive levels of lead.   • In December 2008 “Dinosaur Epoch” Toy Dinosaurs, made in China, were recalled. Surface paint on the toy dinosaurs can contain excessive levels of lead. The recalled “Dinosaur Epoch” Toy Dinosaurs are battery-operated dinosaurs that move and make sounds. The recall includes the orange-colored “Dinosaur Brachiosaurus” (model #1033) and the green, yellow and orange-colored “Dinosaur Carnotaurus” (model #1030).   • In December 2008, Children’s Jewelry, made in China, was recalled. The recalled jewelry contains high levels of lead. This recall involves eight styles of silver-colored metal jewelry: flower ear ring, three flower pendant, necklace with red flower and metal leaf pendant, and miniature sandals in aqua, purple, green, orange and turquoise.   • In December 2008, Newport Rubbed Black 4-in-1 Cribs and Matching Furniture, made in Indonesia, were recalled. The red paint which is underneath the black finish paint on some of the cribs and matching furniture exceeds federal lead limits. If ingested by young children lead can cause adverse health effects. Munire has received one report of a child ingesting the paint. The child was diagnosed with lead poisoning.

The recalled cribs and furniture are made of wood and have a rubbed black finish. Only the “Newport Rubbed Black” cribs and matching furniture manufactured in Indonesia between April 2006-November 2008 are included in this recall. The model number, date, and country of manufacture are printed on the label attached to the side panel of the crib and the date of manufacture is on the back panel of the furniture. They were sold at specialty furniture stores nationwide from April 2006-November 2008 for about $600 for the crib and the matching furniture pieces were sold between $700 and $1,000.   • In December 2008, Calypso Steel Drums, made in Trinidad, were recalled. Surface paint on the recalled toy drums contains excessive levels of lead. The recalled steel drum is made of steel and comes with two wooden drum sticks and a wooden stand. The sides of the drums are painted red. The drum pan is painted black with silver markings to show the location of notes. Each rim is stamped with a #5 or #6. Not all drums stamped with a #5 are affected by this recall. They were sold through mail order catalogues, websites and retail stores nationwide from December 2006-December 2007 for between $50 and $100.   • In November 2008, Best Friends Yin Yang Necklaces Sets, made in China, were recalled. The recalled necklaces contain high levels of lead. This recall involves a set of two necklaces that have a silver-colored metal bead type chain and a lobster-claw clasp. One of the necklaces has a single, metal pendant with the word “Best” attached to a black, yin metal pendant. The other necklace has the word “Friends” attached to a white, yang metal pendant.   • In November 2008, Toy Xylophones, made in China, were recalled. Surface paint on the toy xylophone contains excessive levels of lead. This recall involves a miniature toy xylophone with item number KW20119. The toy xylophone measures about 12 inches long by 5 inches wide. It has a lavender frame, a lavender mallet, and four bars which are orange, yellow, green, and white. The item number can be found on the packaging.

  • In November 2008, “Mini-Televisor” Toys, made in Hong Kong, were recalled. Surface coating on the toy television could contain excessive levels of lead. This recall involves a plastic TV toy. This plastic TV toy has a microphone and is powered by 2 AA size batteries. There is a “TV Painting Board” sticker label on the front panel and carrying handle of the toy.   • In October 2008, Children’s Ball and Heart Necklaces, Portable CD and MP3 Players, made in China, were recalled. Surface coatings on these products could contain excessive levels of lead. This recall involves a Ball and Heart Necklace with pink beads of varying sizes and a pink heart located in the center; a Portable CD Player with flowers and dots available in blue and pink; a pink MP3 Player with purple, green, blue, yellow, and red hearts; and a light blue MP3 Player with a picture of a monkey’s face on the front. They were sold at Limited Too and Justice retail stores nationwide, the Limited Too catazine (catalog), and on www.limitedtoo.com from May 2007- August 2008.   • In October 2008, Toy Boats, made in India, were recalled. The paint on the recalled toy boats contains an excess level of lead. This recall involves two models of tin Pop Pop toy boats.   • In October 2008, Casper the Friendly Ghost® Halloween Mini-Figurines, made in China, were recalled. The recalled Halloween figurines contain high levels of lead in the paint. The recalled Casper the Friendly Ghost® mini-figurines are made of resin and paper, and are three inches tall. They were sold in mini bags decorated with a spider and web design. The Casper the Friendly Ghost® figurines are dressed as: Dracula in a red spider bag, Skeleton in a green spider bag, Devil in a purple spider bag, Mummy in an orange spider bag, Casper® in a blue spider bag, and Wendy the Witch® is in a yellow spider bag. The figurines are stamped with TM & ©Harvey Ent. “Coyne’s & Company” and “CP1030” are printed on a white sticker on the bottom of the bags.   • In September 2008, Sun Smarties™ Children’s Board Skirts, made in China, were recalled. The paint on the grommets of the skirts contains an excess level of lead. The Sun Smarties™ board skirts are peach microfiber with an embroidered flower accent and back pocket. Item number 13926 HIBI is printed on the care label inside the back of the waistband. The skirts were sold in girls sizes 12 months to 4T. The skirts have six grommets, four on the front of the waistband and two on the back pocket.   • In September 2008, Harry Potter Bookends, made in Hong Kong, were recalled. The paint on the bookends contains excessive levels of lead.This recall involves poly-stone bookends painted and shaped in the characters of the Harry Potter book series. Bookend characters include Harry Potter, Hedwig and Hermione, and Crookshank. They were sold through elementary school fundraising programs, discount and dollar stores nationwide from June 2004-January 2006 for between $3 and $28.   • In September 2008, Toy Police Cars, made in China, were recalled. The red paint on the toy cars contains excess levels of lead. This recall involves toy police cars with a friction function. When the toy car is pushed forward, the car builds momentum. When released, the car moves forward on its own. The cars were sold in red/white and purple/white color combinations.   • In December 4, 2007, a San Antonio company voluntarily recalled jars of the Mexican candy Barrilito, a dark brown thick syrup sold in 3.3 ounce (100 gram) glass barrel-shaped jars with white plastic lids for containing lead. The yellow label shows the name “Barrilito” in red outline letters. The label also reads: Productos Avila, S.A. de C.V. Puerto Malaque 1379 Col. Sta. Maria Guadalajara, Jal. Mexico. Recent laboratory tests show lead levels above the 0.1 parts per million lead level considered to be a potential public health hazard by the U.S. Food and Drug Administration. Candy samples ranged from 0.101 to 0.132 parts per million of lead. The tests were part of DSHS product surveillance conducted over the last several months. The words "100 Acre Wood" are molded on the chair back. The plaque inserted into the back of the seat contains molded Winnie the Pooh and Tigger characters. The recall includes the Happy Giddy Gardening Tools and the Sunny Patch Children’s Chairs. They were sold at Target stores nationwide from August 2006 -August 2007 for between $3 and $10.     Gardening tools: caterpillar trowel with an orange and multi-colored handle; kitty cat broom with pink flowers and green handle; pink and green cultivator with a solid green tool portion and pink flowers on the handle; orange and green wood handle hoe and rake with orange flowers; pink and green shovel and trowel with pink flowers; green, orange and light blue snail push broom; multi-colored trowel, hoe, rake with orange on the tool body; multi-colored shovel with solid red on the shovel and eyes on the top of the handle; red and blue owl shaped broom with bristles painted blue, with yellow and black large eyes on the face.
    Children’s Chairs: multi-colored children’s Sunny Patch chairs with a giraffe, monkey, and elephant on the back. The cloth seat and back are striped in orange, yellow, green and blue. The chameleon, butterfly and lady bug chair are not included in the recall.
  • In September 2007 more Thomas and Friends™ Wooden Railway Toys were recalled due to lead in surface paint. The recall involves five toys from the Thomas and Friends Wooden Railway product line: the all-black cargo car, toad vehicle, olive green sodor cargo box and all-green maple tree top and signal base accessories. The front of the packaging has the logo “Thomas & Friends Wooden Railway” in the upper left-hand corner. A tracking code may be located on the bottom of some of the products. Toys marked with codes containing “WJ” and “AZ” are not included in the recall. They were sold at toy stores and various retailers nationwide from March 2003-September 2007 for between $10 and $40. The recall involves various Barbie accessory toys that were manufactured between September 30, 2006 and August 20, 2007. The model names are below.   • In August 2007, Imaginarium Wooden Coloring Cases made in China and sold at Toys "R" Us  and toysrus.com, were recalled. The printed ink on the outer packaging of the wood case contains lead. Also, some of the black watercolor paint contains excessive levels of lead, which violates the federal lead paint standard. The recall involves the Imaginarium brand 213 Piece Wooden Coloring Case which includes crayons, pastels, colored pencils, fiber pens, paintbrush, pencil, water colors, palette, white paint, ruler and pencil sharpener in a light tan wooden carrying case. The case measures about 14 inches high by 19 inches wide. They were sold nationwide from October 20060-August 2007 for about $20.   • In August 2007, Robbie Ducky™ Kids Watering Cans made in China and sold in Jo-Ann’s Fabrics and Craft Stores were recalled. The beak of the watering can contains lead in the paint.  The recalled watering can is yellow with an orange beak and is about 10 inches high by 6 inches wide. "Robbie Ducky™ Garden Collection Duck Watering Can" is printed on a sticker on the bottom of the watering can. They were sold from February-August 2007 for about $10.   • In August 2007, SpongeBob SquarePants™ Address Books and Journals, made in China, were recalled due to possible lead paint on the metal spiral bindings.  The recall involves address books and journals with SpongeBob SquarePants™ character on the front cover and a black metal spiral binding. The UPC numbers (80773007505 for the address book and 80773002260, 80773075501 and 80773007551 for the journal) are printed on the back covers.   • In August 2007 Spinning Tops and Tin Pails made in China were recalled. Surface paints on the wooden handles of the tops and pails contain excessive levels of lead.  The recalled tops and pails are primarily metal and have wooden handles. The tops are painted with Thomas and Friends, Curious George, or a circus scene. The pails are painted with Thomas and Friends, Curious George, or in a solid red or yellow color. Tops with plastic handles are not included in this recall.  They were sold at specialty toy stores and gift shops nationwide from July 2001-July 2002. The tops were sold for about $13.   • In August, 2007, Mattel’s “Sarge” die cast toy cars, made in China, were recalled.  Surface paints could contain lead.  The recall involves die cast “Sarge” 2 ½ inch toy cars. The toy looks like a military jeep and measures about 2 ½ inches long by 1 inch high by 1 inch wide. The recalled toy has “7EA” and “China” on the bottom. The “Sarge” toy car is sold alone or in a package of two, and may have the product number M1253 (for single cars) and K5925 (for cars sold as a set) printed on the packaging. The cars marked “Thailand” are not included in this recall. They were sold at retail stores nationwide from May - August 2007 for between $7 and $20.   •  In August, 2007, Sesame Street, Dora the Explorer, and other children's Fisher-Price toys made in China were recalled.  Surface paints could contain excessive levels of lead.   • In July 2007, Sleeping Beauty Crown and Cinderella Star Earring Sets, made in China, were recalled. The Sleeping Beauty Crown set contains two pairs of earrings; one pair is shaped as pink crowns and the other pair is shaped as the Sleeping Beauty character. The Cinderella Star Earring set contains two pairs of earrings; one pair is shaped as blue stars and the other one is shaped as the Cinderella character. The packaging is shaped as a pink heart and “The Wonderful World of Disney” is printed in the front.  They were sold at Wal-Mart Stores in Florida from February 2007 to June 2007 for about $5.   • In June, 2007, “Accessories” Silver Stud Earring Sets, made in China, were recalled.  The earrings are oval-shaped, silver-colored studs. “ACCESSORIES” is printed on the front of the earrings’ packaging.   • In May 2007, Eli’s Small Drums and Liberty’s Large Drums, made in China, were recalled.  The red paint on the drums contains high levels of lead. The recalled drums are made of wood and come with two wooden drum sticks. The sides of the drums are painted blue with white stars and the tops and bottoms feature an antique U.S. flag decoration. The Eli’s Small Drum measures 4 ¾ inches in diameter and 3 ½ inches tall. The Liberty’s Large Drum measures 6 ¾ inches in diameter and 4 inches tall. The Eli’s Small Drum has item number 654933 printed on its hangtag and packaging. The Liberty’s Large Drum has item number 654934 printed on its hangtag and packaging.   • In May 2007, Children’s Metal Jewelry, made in China, was recalled.  Some of the recalled necklaces, bracelets, earrings, and charms are metallic, multi-colored, and have “High School Musical” or pictures of “High School Musical” actors printed on them.   • In May 2007, Children’s Rings with Dice or Horseshoes, made in India, were recalled. These rings were subject to the July 2004 recall of 150 million pieces of children’s metal jewelry. The firm placed the recalled rings that it had pulled from stores back into circulation. The recalled rings are silver with either dice or horseshoes on top. The numbers on some of the dice are painted in various colors, others are not painted. The horseshoes have either pink and green or purple and yellow painted polka dots. They were sold in vending machines located in malls, discount, department and grocery stores in the Baltimore, Maryland area from August 2004-March 2007 for about 25 cents. The product’s packaging is an orange box with the words “Anima” and “BAMBOO Collection Games” are printed on each side.  They were sold at Target stores nationwide from December 2006-April 2007 for $10.
